In the following we inform about the collection of personal data when using our website. Personalndata is all data that is personally available to you, e.g. name, address, e‑mail addresses, user behaviour.

Responsible acc. Art. 4 para. 7 of the EU General Data Protection Regulation (GDPR / DSGVO) is BU Power Systems GmbH & Co. KG, Perkinsstrasse 1, 49479 Ibbenbüren (see our imprint at https://bu-perkins.com/regulatory/).

Our data protection officer, Rainer Lukas, can be contacted at:

prospecter Unternehmensberatung, Hans-Sachs-Straße 4, 45879 Gelsenkirchen, Germany,
e‑mail address: [email protected], phone number: +49 209 8830 5031.

If we use contracted service providers for individual functions of our service or wish to use your data for advertising purposes, we will inform you in detail below about the respective transactions. In doing so, we also name the specified criteria for the storage duration.

2. Your Rights

2.1 You have the following rights with respect to personal data concerning you:

  • right to information,
  • right to rectification or erasure,
  • right to restriction of processing,
  • right to object to the processing,
  • right to data portability.

You also have the right to complain to us about the processing of your personal data by a data protection supervisory authority.

3. Collection of personal data when visiting our website

3.1 In the case of purely informative use of the website, i.e. if you do not register or otherwise provide us with information, we will only collect the personal data that your browser transmits to our server. If you wish to view our website, we collect the following data, which is technically necessary for us to display our website and to ensure the stability and security (legal basis is Art. 6 (1) sentence DSGVO (GDPR)):

  • IP address
  • date and time of the request
  • time zone difference to Greenwich Mean Time (GMT)
  • content of the requirement (concrete page)
  • access status / HTTP status code
  • each transmitted amount of data
  • website from which the request comes
  • browser
  • operating system and its interface
  • language and version of the browser software

3.2 In addition to the aforementioned data, cookies are stored on your computer when you use our website. Cookies are small text files that are stored on your hard drive assigned to the browser you are using and by which the body that sets the cookie (here through us) receives certain information. Cookies are not able to run programs or transmit viruses to your computer. They serve to make the internet offer more user-friendly and effective overall.

3.3 Use of cookies:

a) This website uses the following types of cookies, the respective scope and operation are explained below:

- transient cookies (see b)
— persistent cookies (see c).

b) Transient cookies are automatically deleted when you close the browser. These include in particular the session cookies. These store a so-called session ID, with which various requests from your browser can be assigned to the common session. This will allow your computer to be recognized when you return to our website. The session cookies are deleted when you log out or close the browser.

c) Persistent cookies are automatically deleted after a specified period, which may differ depending on the cookie. You can delete the cookies in the security settings of your browser at any time.

This website uses the cookie “cookie banner”. This cookie is generated by our cookie banner and recognizes that it has been confirmed before. The cookie is deleted after one year.

This website also uses a cookie “__cfduid”. This cookie is needed for the Content Delivery Network Cloudflare, so that access to our website is as fast as possible.

d) You can configure your browser setting according to your wishes and e.g. decline the acceptance of third-party cookies or all cookies. Please be aware that you may not be able to use all functions of this website.

4. Contact Form

When you contact us by e‑mail or through a contact form, the information you provide (your e‑mail address, your name and telephone number if applicable) will be stored by us to answer your questions. We delete the data that arises in this context after the storage is no longer required, or limit the processing if there are statutory retention requirements.

The legal basis for the processing of the data transmitted in the course of sending an e‑mail is Article 6 (1) lit. f DSGVO (GDPR). If the e‑mail contact aims to conclude a contract, then additional legal basis for the processing is Art. 6 para. 1 lit. b DSGVO (GDPR).

5. BU TechShare

5.1 We offer selected customers the opportunity to register for the use of our customer portal BU TechShare by providing personal data. Registration takes place via the account manager responsible for you.

  • upload data to exchange with our engineers
  • synchronize BU TechShare with their mobile devices so that the above mentioned data is available offline and automatically updated as soon as it is online again
  • set up subaccounts for their customers

5.2 When registering through a customer service representative, the following data will be collected and stored as part of the registration process for each customer account to be set up:

  • company name
  • first given name
  • surname
  • e‑mail address

As part of the registration process, the consent of the user to process this data is obtained. As a user, you have the option of canceling the registration at any time. A disclosure to third parties does not occur.

5.3 If you use our portal, we will store the data required for the fulfillment of the contract until you finally delete your access. Furthermore, we will store the voluntary data provided by you for the time of your use of the portal, unless you delete it before. All information can be managed and changed in the protected customer area.

Legal basis for the use of your data is in the cases of your consent Art. 6 para. 1 lit. a DSGVO (GDPR).

6. BU WebWarehouse

6.1   We offer selected customers the opportunity to register for the use of our customer portal BU WebWarehouse by providing personal data. Registration takes place via the account manager responsible for you.

Via the customer portal BU WebWarehouse registered customers can place spare parts orders and retrieve the history of their already placed orders.

6.2   When registering with a customer service representative, the following data will be collected and stored as part of the registration process for each customer account to be set up:

  • company name
  • first given name
  • surname
  • e‑mail address

As part of the registration process, the consent of the user to process this data is obtained. As a user, you have the option of canceling the registration at any time. A disclosure to third parties does not occur.

6.3   If you use our portal, we store your data required for the fulfillment of the contract until you finally

delete your access. Furthermore, we will store the voluntary data provided by you for the time of your use of the portal, unless you delete it before. All information can be managed and changed in the protected customer area.

Insofar as you place orders via the customer portal, we are required by commercial and tax regulations to store your address, payment and order data for a period of ten years. However, after two years we are restricting processing, i.e. your data will only be used to comply with legal obligations.

Legal basis for the use of your data is in the cases of your consent Art. 6 para. 1 lit. a DSGVO (GDPR) and in the case of contracts concluded via the customer portal Art. 6 para. 1 lit. b DSGVO (GDPR).

7. Newsletter

7.1     If we have received your e‑mail address in connection with the purchase of a service or the purchase of goods and you have not objected to the use of your e‑mail address, we will inform you in the future about your own similar goods or services.

The legal basis is Article 6 (1) (1) (f) DSGVO (GDPR) and Section 7 (3) UWG.

You can contradict the sending of the newsletter at any time and unsubscribe from the newsletter. You can declare the objection by clicking on the link provided in each newsletter e‑mail, by e‑mail to [email protected] or by sending a message to the contact details stated in the imprint.

7.2     In all other cases, we will only send you our newsletter if you have subscribed to it with your consent. Our newsletter informs you about our current interesting offers. The advertised goods and services are named in the declaration of consent.

To register for our newsletter, we use the so-called double opt-in procedure. This means that after you have registered, we will send you an e‑mail to the e‑mail address specified in which we ask you to confirm that you wish to receive the newsletter. In addition, we store your IP addresses and times of registration and confirmation. The purpose of the procedure is to prove your registration and, if necessary, to inform you about possible misuse of your personal data.

The only requirement for sending the newsletter is your e‑mail address. The specification of additional, separately marked data is voluntary and will be used to address you personally. After your confirmation, we will save your e‑mail address for the purpose of sending you the newsletter.

The legal basis is Art. 6 para. 1 sentence 1 lit. a DSGVO (GDPR).

You can revoke your consent to the sending of the newsletter at any time and unsubscribe from the newsletter. You can declare the cancellation by clicking on the link provided in every newsletter e‑mail or by e‑mail to [email protected] or by sending a message to the contact details provided in the imprint.

7.3     The shipping of our newsletter is done via MailChimp. Further information on data protection can be found at https://mailchimp.com/legal/.

MailChimp will only use your information to send our newsletter as described above. A passing on to third or for use for other purposes does not take place.

The legal basis for forwarding to MailChimp is Art. 6 para. 1 lit. f DSGVO (GDPR) and a contract processing contract pursuant to Art. 28 (3) sentence 1 DSGVO (GDPR).

8. Matomo Web Analysis

We use the open source software tool Matomo (formerly PIWIK) on our website to analyse our users’ surfing behaviour. We have set Matomo in such a way that no cookie is set by the application. The software runs exclusively on the servers of our website. A storage of the personal data of the users only takes place there. The data will not be passed on to third parties. The software is set up in such a way that the IP addresses are not stored completely, but the last byte of the IP address is masked (e.g. 192.168.017.xxx). In this way it is no longer possible to assign the shortened IP address to the calling computer.

If you do not agree with the storage and evaluation of this data from your visit, you can object to the storage and use of this data at any time by clicking on the mouse. In this case, a so-called opt-out cookie is stored in your browser, which means that Matomo does not collect any session data. Please note that the complete deletion of your cookies means that the opt-out cookie is also deleted and may have to be reactivated by you.

Alternatively you can also activate the so-called “do-not-track” function in your browser. Then, no session data is collected by Matomo.

You have the possibility to prevent that actions you take here are analysed and linked. This will protect your privacy, but will also prevent the owner from learning from your actions and improve the usability for you and other users.

9. Cloudflare

This website uses SSL encryption for security reasons and to protect the transmission of confidential content, such as requests you send to us as a site operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line. If SSL encryption is activated, the data you transmit to us cannot be read by third parties. In order to be able to offer you secure data transmission on our website using SSL encryption, we use the service of Cloudflare, Inc. 101 Townsend St San Francisco, CA 94107. We have concluded a corresponding agreement with Cloudflare based on the DSGVO for order processing. Cloudflare is a certified participant of the EU-US Privacy Shield Framework. Cloudflare is committed to handling all personal data held by European Union (EU) member states in accordance with the Privacy Shield Framework and its applicable principles. Further information about the Privacy Shield Framework can be found on the US Department of Commerce’s Privacy Shield list at [https://www.privacyshield.gov]. Cloudflare collects statistical information about visits to this website. Access data includes: name of the website accessed, file, date and time of access, amount of data transferred, notification of successful access, browser type and version, the user’s operating system, referrer URL (the previously visited page), IP address and the requesting provider. Cloudflare uses the log data for statistical evaluations for the purpose of operation, security and optimization of the offer. Please read also in addition the data protection regulations of Cloudflare which are callable here https://www.cloudflare.com/privacypolicy/
